সমন কি?
সমন হল একটি আইনী দলিল যা আইনী কার্যধারায় জড়িত একজন ব্যক্তির বিরূদ্ধে জারি করা হয়। যখন কোন ব্যক্তির বিরুদ্ধে কোন আইনি ব্যবস্থা নেওয়া হয় বা কোন ব্যক্তির আদালতের কার্যধারায় সাক্ষ্য দেওয়ার জন্য আদালতে উপস্থিত হওয়ার প্রয়োজন হয়, তখন সেই ব্যক্তিকে আহ্বান জানাতে এবং কার্যধারার প্রদত্ত তারিখে তার উপস্থিতি নিশ্চিত করার জন্য, সমন জারি করা হয়। যদি সমন যথাযথভাবে service না করা হয় তবে প্রতিপক্ষের বিরুদ্ধে কোন ব্যবস্থা নেওয়া যায় না। যদি আসামি সমন প্রাপ্তির পরেও আদালতে উপস্থিত হতে ব্যর্থ হয়, তবে আদালত মামলাটিতে একতরফা শুনানি করে। সমন দেওয়ানি এবং ফৌজদারি উভয় মামলায় জারি করা হয়।
What is summons?
A summons is a legal document that is issued by a Court on a person involved in a legal proceeding. When a legal action is taken against a person or when any person is required to appear in the court as a witness in a court proceedings, to call upon such person and ensure his presence on the given date of the proceedings, summons is served. If the summons is not duly served then no action can be taken against the defendant. If defendant fails to attend court after receiving summons, he will be ex-parte by the Court.A summon may be issued in both civil and in criminal cases.
